References to "we", "us" or "our" throughout www.honeybirdette.com.au ("the Website") are to Honey Birdette (Aust.) Pty Ltd.

The use of the Website and the purchase of any goods ("Goods") from the Website is governed by these terms and conditions ("Conditions"). We reserve the right to modify these terms and conditions from time to time without notice to you.

• You are an adult at least 18 years of age and can lawfully enter into and form contracts under Australian law.
• You have familiarised yourself with our Returns Policy and Delivery & Payment.
• You have read and understood the Disclaimer at the bottom of this page.
• You are familiar with the customs policies of your country and agree that you will be responsible for compliance with all local laws which may restrict the importation of certain goods and that you alone will be responsible for payment of any present or future tax or impost, duty or charge which may be imposed or assessed by any relevant regulatory authority on the goods purchased on the site.
• All prices quoted on the site are inclusive of Australian Goods and Services Tax.
  You understand that, to the fullest extent permitted by law, Honey Birdette makes no warranties of any kind whatsoever whether express or implied, and specifically no warranty of merchantability or fitness for a particular purpose and in no event shall Honey Birdette be liable, whether in contract or tort for any damages to the user in respect of economic loss, any loss or damage to property or death or injury to any person of whatever nature and however or wherever sustained that arises out of or is in any way connected with the purchase or delivery of any product.
• Where any condition or warranty cannot be excluded under applicable legislation Honey Birdette liability for breach of condition or warranty shall be limited to either: (a) replacing the product; or (b) crediting the cost of the product to the user. In no event shall Honey Birdette be liable for exemplary, special or consequential damages or losses or loss of profits.
• Honey Birdette and its logo are the subject of registered trademark applications in Australia and may not be used in connection with any product or service that is not Honey Birdette in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Honey Birdette.
• The site or any portion of the site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose that is not expressly permitted by Honey Birdette. Honey Birdette has the right to refuse service, terminate accounts or cancel orders in its discretion, including, without limitation if Honey Birdette believes that customer conduct violates applicable law or is harmful to the interests of Honey Birdette and its affiliates.
• The site may only be used for lawful purposes and in a lawful manner. When ordering from Honey Birdette you are the purchaser of the goods and must comply with all applicable laws and regulations. It is your responsibility to investigate and ensure that you can lawfully purchase the goods you order.
  Prices and products are subject to change at any time without notice.
• Colours depicted should be used as a guide only as some fabrics and materials may appear different depending on lighting conditions resulting in colour variations shown on the website and in the catalogue.
• Amendments to orders can be made by contacting Honey Birdette via email or telephone and speaking with someone who will then receive permission to change the order. If an order has already been dispatched, then postage costs will apply.
• You must contact Honey Birdette either by phone, fax or email regarding any exchange/refund return of product prior to return within 7 days of original dispatch date.
• If you change your mind about the purchase, Honey Birdette is happy to exchange unused and unopened products. All additional postage costs will be at the customer's expense.
• If a product is faulty, Honey Birdette will provide a full refund or exchange including all additional delivery costs.
• If lingerie is not suitable and you require an alternate size, colour or style, Honey Birdette will exchange goods. The customer is required to pay for return postage to Honey Birdette, however, Honey Birdette will pay for returned postage to the customer.
• Access to the website may be suspended, restricted or terminated at any time.
• There is no charge imposed by us for accessing the website but you must pay the cost of the communications link you use to visit the website.

We accept no responsibility for web sites or other information, practices or products of other parties linked to the Website. Your dealings with persons found via the Website are between you and such persons and we will not be liable for any loss or damage arising out of such dealings.

Contract information

Your submission of an order represents an offer to purchase the Goods indicated by you and it is not binding on us until we have notified you that an order is accepted. All advertisements and communications are made by us until your order is accepted by us are invitations to treat only and are not offers. This means that if Goods are shown on the site but are not available or are incorrectly priced or otherwise incorrectly described, Honey Birdette shall not be obliged to sell you those goods.

As well as selling via the website, we sell our product through mail order through our West End store. Normally, prices on the Website are the same as the prices in catalogues currently being mailed, or on offer in our stores. However, prices may differ with a catalogue (or a store) because: (i) We have a Special Offer on the Website, in a Catalogue or in a store (ii) The catalogue you have may have been replaced by a more up to date catalogue. As a result, we cannot guarantee that all prices are the same. We reserve the right to amend prices throughout the life of the catalogue with prices being correct as of going to print. Store prices can only be met in the store where the goods are offered.

Fraud

Any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution. Honey Birdette does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website. It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. All persons found to have placed a fraudulent order will be prosecuted.
